DIVORCE
Divorce is simply the termination of marriage. From a legal point of view, the divorce itself is the easiest part. For the people going through it the divorce may be very difficult emotionally but the legalities are quite simple.
ADULTERY
Of the four fault-based grounds for divorce, adultery garners by far the most attention. Making the decision to pursue adultery as a grounds for divorce can be complicated for a number of reasons.
Spousal Support
The term “alimony” is not used in Virginia. Money that must be paid to a former spouse for their support after the divorce is called “spousal support.” The authority to award spousal support is granted to the Circuit Court
Child Custody
In Virginia, judges decide what the parenting arrangements will be if the parents cannot agree. It is a factor-based, discretionary decision. A lawyer will be appointed to represent the child’s interests.
Child Support
Virginia has a formula that sets child support based upon the parents’ incomes, day care costs, the health insurance premiums for the child, and the amount of time each parent has the child in their care.
Property Division
The judge in a divorce case decides how the parties’ marital property will be divided and who will pay each of their debts. This is another factor-based, discretionary decision. As long as the judge says they have considered the factors, virtually any allocation will be upheld on appeal.
Appeals
Appeals to the Virginia Court of Appeals or Virginia Supreme Court are not a new trial. They consider whether the trial judge applied the law correctly, and turn on technical legal issues; arguments are made in written briefs.
